Terms and Conditions for Tintune

1. Scope of These Terms and Licence

These Terms of Use ("Terms" or "EULA") apply to all use of the Tintune app and the website tintune.com, including digital content, subscriptions, palettes and any physical goods (the "Services"). By downloading, installing, accessing or using Tintune, you accept these Terms.

For apps obtained through the Apple App Store, you acknowledge that this EULA is concluded between you and Tintune only, and not with Apple. Tintune, not Apple, is solely responsible for the Tintune app and its content.

The Tintune app and all digital content are licensed, not sold, to you. You obtain a limited right to use Tintune as described below; you do not obtain ownership of the app, palettes, or underlying data.

If you obtained Tintune through the Apple App Store, these Terms supplement Apple’s Media Services Terms and Usage Rules. Where mandatory App Store terms conflict with these Terms, Apple’s terms prevail.

3. User Accounts and Eligibility

You must be at least 18 years old and a consumer (not a business) to purchase or subscribe via Tintune. You may need to create an account and provide certain personal details. You are responsible for keeping your login details secure and for all activity under your account.

5. Licence and Use of App and Content

All intellectual property rights in the Tintune app, palettes, texts, videos and other content belong to Tintune/Anders Barslund or our licensors. Subject to your continuous compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to:

This licence is for personal, non-commercial use unless otherwise stated. You may not share, sell, copy, or exploit the app, its features, or any purchased content except as expressly allowed in these Terms.

Your right to access subscription content ends when your subscription expires, except for digital content purchased separately outside the subscription. User-created palettes are for your own personal use unless otherwise agreed in writing.

When using Tintune, you must also comply with any applicable third-party terms of agreement, including wireless data service agreements and platform-specific policies for services integrated into the app.

8. Complaints and Right of Withdrawal

For physical goods, the Danish Sale of Goods Act applies, including a 24-month complaint right. If you discover defects, please contact us promptly and describe the problem.

For digital content and subscriptions, complaint rights follow Danish law and these Terms. If you experience technical issues, please contact us so we can attempt to remedy the problem.

9. NCS® System and Trademarks

Tintune includes a limited selection of NCS 2050 Standard colours as references to support colour combinations. The NCS System® and NCS® designations are owned by NCS Colour AB. Tintune’s use of NCS references is under licence from NCS Colour AB.

10. External Services and Technical Data

Tintune may enable access to external services or websites. Use of such services is at your sole risk. Tintune is not responsible for third-party content, availability or security.

Tintune may collect non-personal technical information (such as device model, OS version and crash logs) to provide updates, security, support and improvements. No personally identifiable data is collected without your consent. For more details, see our Privacy Policy.

Tintune is solely responsible for providing maintenance and support for the Tintune app. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.

By using Tintune, you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Disclaimer (No Warranty)

Tintune and all Services, including palettes, images, previews and digital content, are provided "as is" and "as available", without warranties of any kind, express or implied.

Tintune disclaims all warranties regarding merchantability, fitness for a particular purpose, non-infringement, accuracy, quiet enjoyment, or availability. You assume all risk associated with the use of Tintune.

If you obtained Tintune via the Apple App Store and the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) paid for the app. To the maximum extent permitted by law, Apple has no further warranty obligations with respect to Tintune, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty will be Tintune’s sole responsibility.

12. Limitation of Liability

To the maximum extent permitted by law, Tintune and Colours by Barslund are not liable for any indirect, incidental, special or consequential damages, including loss of profits, data, business opportunities or goodwill, arising out of or in connection with your use of Tintune.

Where liability cannot be excluded, it is limited to the amount you have paid for access to the Services during the 12 months preceding the claim. These limitations do not affect rights that cannot be waived under Danish consumer law.

Tintune, not Apple, is responsible for addressing any claims from you or any third party relating to the app or your possession and/or use of the app, including but not limited to product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

In the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Tintune, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.

13. Termination

This EULA remains in effect until terminated. Your rights terminate automatically without notice if you:

Upon termination, you must stop using Tintune and delete any palette files or content stored locally. Tintune may suspend or restrict your access in order to protect our services, users or licensors.

14. Disputes and Governing Law

These Terms are governed by Danish law. Disputes can be brought before the Court in Lyngby or the court where you reside, to the extent permitted by applicable consumer law.

15. Palette License (Annex)

The use of Tintune colour palettes and preview images is further governed by our Palette License, which forms an integral part of these Terms. The Palette License specifies permitted commercial uses, restrictions on redistribution, scraping and AI training, and additional NCS-related limitations.

You and Tintune acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a thrid-party beneficiary.

NCS®, Natural Colour System® are registered trademarks of NCS Colour AB, used by Tintune under licence.
