Palette License

This Palette License forms part of the Tintune Terms & Conditions and governs how you may use all colour palettes and preview images provided by Tintune. For legal details and additional rights and obligations, please also read our full Terms & Conditions and Privacy Policy.

Licence Grant

Subject to your continuous compliance with this Palette License and the Terms & Conditions, you are granted a limited, non-exclusive, non-transferable, revocable licence to use Tintune colour palettes and preview images for the permitted purposes described below. No ownership of palettes, colour data or image assets is transferred to you.

NCS® Licensing Notice

Tintune includes a limited selection of NCS 2050 Standard colours as references to support colour combinations. The NCS System® and NCS® designations are owned by NCS Colour AB and are used by Tintune under licence. See the official trademark guideline: ncscolour.com/trademark-guideline.

• Tintune’s use of NCS references covers a limited selection of the NCS 2050 Standard colours and does not imply ownership of, or any rights in, the NCS System®.
• Scope & Territory: NCS-referenced Colour Wheel products are offered and sold in Europe only. Availability may be restricted or withdrawn outside this territory.

End-User Restrictions for NCS Data

• Do not extract, scrape, bulk-download, or reverse-engineer NCS colour data from the app, website, or any Tintune materials.
• Do not use NCS codes obtained via Tintune to create competing products or datasets.
• Do not use NCS codes to train, refine, or generate artificial intelligence models.
• Any use of NCS codes beyond personal project reference requires permission from NCS Colour AB.

Permitted Uses

• You may use Tintune colour palettes for personal and commercial projects – including websites, apps, print, presentations and design work – with or without attribution.
• You may modify palettes for use in your own creative work.
• You may share images of your own work that uses Tintune palettes (e.g., screenshots, design previews).

Restrictions

• You may not sell, sublicense, distribute, or offer Tintune palettes or images as standalone products or as part of a collection, template, or design resource, whether for commercial or non-commercial use.
• You may not upload, publish, or otherwise submit Tintune palettes or images to stock image sites, design marketplaces, or palette-generating tools or apps.
• You may not reverse-engineer, parse, scrape, stockpile, or otherwise bulk-download palettes or images for the purpose of creating competitive products or services.
• You may not use Tintune palettes or images to train, refine, or generate artificial intelligence (AI) models, including image generators or colour suggestion tools.
• You may not use Tintune palettes or images in any way that infringes upon the copyrights, trademarks, or intellectual property rights of Tintune, Colours by Barslund, or any third party.
• You may not redistribute our palettes or images on a stand-alone basis or as a compilation, either free or paid.
• You may not use Tintune palettes or images for any unlawful, defamatory, or offensive purposes.

When using Tintune, you must also comply with any applicable third-party terms of agreement, including wireless data service agreements and platform-specific policies for services integrated into the app.

No Warranty

Palettes and preview images are provided "as is" and without any warranties of accuracy, completeness, fitness for a particular purpose or non-infringement. You assume all risk associated with the use of Tintune palettes.

Limitation of Liability

To the maximum extent permitted by law, Tintune and Colours by Barslund are not liable for any indirect, incidental, special or consequential losses arising from your use of Tintune palettes, including but not limited to loss of profits, data, business opportunities or goodwill.

Termination

This Palette License will terminate automatically if you breach its terms or the Terms & Conditions. Upon termination, you must cease all use of Tintune palettes and delete any palette files or images stored locally. Tintune may suspend or restrict access to protect our services, users and licensors.

You and Tintune acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a thrid-party beneficiary.
